Secretary of State, Kevin Shelley, finds himself accused
of providing misleading and false information
to the
public in what some say is a blatant attempt to harm
the signature gathering process of the Save Our License
Initiative. In addition,
Shelley is already under fire for misuse of federal tax
dollars and other allegations of impropriety
“It’s quite alarming that Shelley would
incorrectly list the due date for Save Our License petitions,” stated
Mike Spence, President of the California Republican Assembly
which is sponsoring the initiative. “As a result,
we’ve had erroneous press reports which are causing
confusion among volunteers gathering signatures throughout
the state.”
The Secretary of State’s Website lists March
4th as the circulation deadline -- the day that petitions
are due to be turned in. The correct date is February
22nd according to the official filing schedule originally
provided by Shelley’s office.
“If a significant number of individuals turn in
their petitions to us too late based on this incorrect
information, it could jeopardize our qualification for
the ballot,” Spence added.
“Is this retaliation for CRA’s campaign
calling on Shelley to resign?” asked Jeff Evans,
the political consultant who set up the award-winning
ShelleyMustResign.com website for CRA. “The California
Republican Assembly was the first organization to call
for Shelley’s resignation following the allegations
of illegal campaign contributions and misuse of federal
tax dollars.”
None of the other initiatives listed as being in circulation
have incorrect deadlines posted, noted Evans. “This
is very troubling and a further example of why Shelley
must resign immediately. We need a fair and competent
Secretary of State that can honestly oversee our elections
process.”
“We’re looking into our legal options at
this point,” said Spence. “The negative impact
of this false information could be significant.”
The Save Our License Initiative, which would ban government
from providing tax funded benefits like driver’s
licenses to illegal aliens, needs approximately 600,000
signatures to qualify for the ballot.

ALIEN DRIVER'S LICENSE BILL!
At 5:25 pm on Friday, Aug. 27th the State Senate
PASSED a new version of the Driver's Licenses for Illegal
Aliens bill.
In a last-minute maneuver known as a "gut and amend," the
Senate changed the text of an existing bill and passed
it with a vote of 22-14.
The new bill is AB 2895 by Nunez. The bill must still
pass the State Assembly.

To Illegal Aliens
The "Save Our License Committee" joins with Assemblyman
Mark Wyland
in announcing a new initiative designed
to prevent California State and local governments
from granting benefits to illegal aliens.
“When the legislature gives benefits like driver’s
licenses and in-state tuition breaks to illegal aliens
it is sending the signal that illegal immigration is
okay,” said Mike Spence, with the Save Our License
Committee. “Well it is not okay, and the vast majority
of Californians believe it is not okay.”
“The Save Our License Initiative contains three
main provisions,” he added. “First, the government
will not provide any benefits not mandated by federal
law. Second, the government will defend this law against
any and all legal challenges. Third, individual citizens
will be granted the power to sue to compel compliance
with the law.”
“This initiative is about empowering Californians
to stand up and do what the legislature will not do,” added
Assemblyman Mark Wyland. “We should not be granting
special tax-funded benefits to illegal aliens, period.
And in this time of huge budget deficits, there is even
more reason to stop the giveaway of our tax dollars.”
“One of the driving issues in the recall of Gray
Davis last year was SB 60, the law giving driver’s
licenses to illegal aliens,” said Victor Valenzuela,
a member of the Save Our License committee. “Now
the legislature is trying to pass another version of
this. It’s time to give the power to the people
to once again say ‘no more.’”
The Save Our License initiative specifically prohibits
the government from giving California driver’s
licenses, government identification cards and in-state
college tuition to illegal aliens. In addition, it spells
out a list of benefits for which the government would
be prohibited from providing to illegals.
“The people of California have spoken out strongly
on this issue, only to be thwarted by the State in not
defending Prop. 187, and by the legislature continuing
to award benefits to illegals,” added Sen. Dick
Mountjoy, one of the authors of Proposition 187.
“This measure will force the government to defend
it in court through all appeals,” he added. “Most
experts agree that the bulk of Proposition 187 would
have been upheld had the state continued to appeal the
case, and we’ve addressed that in this initiative.”
More importantly, the new initiative will give power
to individual citizens to force the government to comply
with the law.
“Under this initiative, any citizen in California
will have the right to sue their state or local government
to ensure compliance with the law,” added Spence. “That
means if a city, like San Francisco, decides to ignore
the law, an individual could bring suit to compel the
city to follow the law.”
In addition, any government official that is willfully
disobeying the law could be held personally liable for
their actions.
“We are very confident of our success with this
initiative,” noted Spence. “We start with
a strong and enthusiastic base of supporters. We have
financial commitments to help with the paid signature
gatherers. And the legislature is keeping the issue in
front of everyone with their efforts to pass a new driver’s
license bill.”
The Save Our License initiative, which was filed with
the Attorney General today, will amend California’s
Constitution. For it to qualify for the ballot, proponents
must collect approximately 600,000 valid signatures.
Under California law, the Attorney General has fifteen
days to review the language and prepare an official Title
and Summary. If the Attorney General determines that
the initiative may have a fiscal impact, he must forward
it for a fiscal review before issuing the Title and Summary.
Once complete, the Attorney General will transmit it
the Secretary of State who will record is and start the
clock on the signature gathering. Proponents will then
have 150 days to gather the necessary signatures.

DRIVER'S LICENSES ROUND TWO?
Below is the transcript of a radio interview
with California Senator Gil Cedillo, author
of SB 60 and the new SB 1160, at the Los Angeles
Spanish radio station RadioVisa
the week of March 8th, 2004. Cedillo's newly proposed
bill SB 1160 will attempt again to give illegal aliens
California driver's licenses.
Radio host: Respect the Sombrero, the huaraches (leather
sandals). But, they don't want to respect us, senator,
they don't want to give us licenses. How is this bill
coming along, the driver's license bill?
Sen. Cedillo: As far as the governor is concerned, everything
is all right. We are working hard together. We have an
agreement with the governor. There are three important
points [that make up this] agreement. One, the governor
and I want to give a driver's license to all the immigrants
that live in California [and] work here, undocumented
people, those who are in the process of legalizing their
status. Everyone.
Radio host: Everyone?
Sen. Cedillo: Undocumented people, those who are in
the process [of legalizing their status]-everyone. That
is the first point. Second, we want to give the same
license that everyone has.
Radio host: So, no marks? It won't be marked?
Sen. Cedillo: That's right. It won't have a different
color, no different numbers or letters...
Radio host: So, the governor's office is in agreement
with not marking the licenses?
Sen. Cedillo: Yes, because he says, "Gil, I am
an immigrant."
Radio host: Oh, that's great. He should not forget that.
Sen. Cedillo: And the third point is we want to give
it as quickly as possible. Why? Because outside of the
Capitol, there are politicians, radio hosts on the AM
dial...

Sen. Cedillo: Yes, exactly. Juan y

Radio host: They say they are ready to pressure Arnold
Schwarzenegger so he won't approve your plans and thereby
spoil both of your [efforts] to give licenses. Do you
think they will be able to do that, senator?
Sen. Cedillo: There are more than 70% of voters who
today don't want to give any rights, privileges, or responsibilities...
Radio host: How are we going to convince them? How are
we going to convince the voters that they need to do
it?
Sen. Cedillo: I think that, I believe that with this
new proposal, [which includes] verification, insurance,
Schwarzenegger's strong support [and], possibly, the
White House's support, we will be able to present a new
law that will be acceptable for all Californians.
Radio host: And like you say, we have to hurry, otherwise
John and Ken and other people who are against the licenses
will win. When will you be able to present the bill [and
get approval] on the California State Assembly floor?
Sen. Cedillo: It's difficult to say today because we
are working on difficult points. Schwarzenegger and I,
and our teams are looking into a new computer that will
create a new database. We are also talking to the insurance
[industry] to figure out what we can do to give insurance
to all the new undocumented drivers. We are working on
these points daily. We are looking at the system that
the Mexican Consulate has in place, the verification
system they [rely on] to furnish the Consular IDs.
Radio host: Senator, we are running out of time. Sen.
Cedillo is working on a new bill, SB 1160, which will
become law, so undocumented immigrants can finally
get their license, but we have a bunch of enemies out
there.
They say, threaten that even though Gil Cedillo and
Schwarzenegger are working separately to convince legislators
in the
California State Assembly to give drivers' licenses
to undocumented people-here comes the opposition [and]
they
don't want us to have drivers licenses. They are against
security on California roads and that's the plain truth.
What do you say, senator, about all of this? And, please
tell us more about the same machine that we need, which
the Mexican Consulate is using to make the documents
fool proof.
Sen. Cedillo: Exactly. It is possible that we will use
the Mexican verification process and other countries
from Central America, Europe, China will do the same.
Radio host: And when will all this be ready? You tell
us that you can't give us a date today, but the ultra
conservatives, John and Ken, and others are applying
pressure-they don't want to make California roads safer
by giving undocumented drives the ability to learn the
rules and get insurance. How is this war [playing out]?
Sen. Cedillo: They are irresponsible.
Radio host: Yes, they are. It's John and Ken and there
are other stations in San Diego and Sacramento that have
their way of seeing things. They want to politically
drown our community, but it is irresponsible.
Sen. Cedillo: And, good news. The politicians that are
using this as a campaign issue did not win.
Radio host: Do you have a majority [of the votes] in
the Assembly? Senator, do you and Arnold have a majority
to win?
Sen. Cedillo: Schwarzenegger says that he has Republican
votes, per our agreement, but it is difficult. We are
working every day to get the votes we need in the Legislature.
Schwarzenegger says he has about half a dozen and we
have all the Democrats.
Radio host: Oh, that's great. Mr. Medina wants to ask
you a question.
Mr. Medina: I just want to say one thing. I want to
clarify something. Someone, who may face this problem,
this is just in anticipation, someone who is asking for
their driver's license and who has a criminal record
in Mexico or China. What will happen then?
Sen. Cedillo: We will have an agreement between Mexico,
California, Bill Lockyer, [and] the police. We will have
a verification process. It is possible that we will use
the same system that is used to issue the Consular IDs.
Radio host: Right. Exactly. People who had problems
in Mexico will not be able to apply for it. So, why bother
applying? Well, senator, we are right along side you
in this fight.
Sen. Cedillo: Your support is very important. I am not
concerned about the driver's license bill or my work
with Schwarzenegger. My concern lies with the [voters']
reaction in November. Why? Because with a popular vote
they can change any law I write.
Radio host: Right, of course.
Sen. Cedillo: So, the fight will be ongoing even when
you and Schwarzenegger pass a law to give drivers licenses?
These people will turn it into a popular referendum.
Radio host: Well, thank you, senator.
Sen. Cedillo: I will work for this all my life...until
I die.
Radio host: Yes, we know. We are your cheerleaders.
Sen. Cedillo: I have an understanding with my wife and
with my community.
Radio host: Thank you, senator, for working so hard.

Poll Shows Californian's Know About 'Licenses for Illegals'
Issue
Save Our License, a project of the California Republican
Assembly, has released the results of a new poll showing
that significant majorities among this March's primary
voters oppose licenses for illegals.
"The poll shows an amazing awareness of the licenses
for illegals issue," said Mike Spence, President
of the California Republican Assembly. The poll, conducted
by Probolsky Research, showed that 94.9 percent had heard
of this issue.
The poll also shows that over 70 percent of people oppose
the licensing of illegals, and over 66 percent would
vote for a ballot measure to limit driver's licenses
to citizens and legal residents.
"The poll confirms that our efforts are on the
right track. If the legislature tries to pass this scheme
again, we will be forced to place a measure on the ballot." Spence
added.
